When Do You Need a Building Permit for a Deck in Muskoka?
Ontario Building Code requirements, township rules, shoreline setbacks and the application process explained for Muskoka property owners.
Does Every Deck in Muskoka Need a Building Permit?
Not every deck requires a building permit in Ontario, but most do. Under the Ontario Building Code (OBC), a building permit is required for any deck that meets one or more of these conditions:
Attached to a building: If the deck is connected to the house, cottage or any other structure, a permit is required in virtually all Muskoka townships.
Higher than 24 inches (600 mm) above grade: Any deck surface more than two feet off the ground requires a permit and must have code-compliant guards (railings).
Larger than 108 square feet (10 m2): Even freestanding ground-level decks need a permit if they exceed this size.
A small, freestanding platform (under 24 inches high and under 108 square feet) that is not attached to any building is generally permit-exempt under the OBC. However, individual municipalities can impose stricter rules, so it is always worth checking with the local building department.
What About Shoreline Setback Rules?
Lakefront and waterfront properties in Muskoka are subject to shoreline setback regulations under the local zoning bylaw. These bylaws specify a minimum distance that structures (including decks) must be set back from the high-water mark. Setback distances vary by township and lake classification but typically range from 15 to 30 metres.
Setback rules are separate from the building permit and are enforced through the zoning process. If the proposed deck encroaches on the setback, a minor variance from the Committee of Adjustment may be required before a building permit can be issued.

Permit applications in Muskoka are processed by the building department of the township where the property is located. The main townships are:

What Documents Are Needed for a Deck Permit?
A typical deck permit application in Muskoka requires:
- Completed building permit application form (available from the township)
- Site plan showing the property boundaries, existing buildings, the proposed deck location, setback distances and septic system location
- Construction drawings showing the deck dimensions, footing locations, framing plan, railing details and connection to the building (if attached)
- Structural engineering drawings (required for elevated decks, rooftop decks and complex structures)
- Proof of property ownership
How Much Does a Deck Permit Cost?
Building permit fees in Muskoka townships are based on the estimated construction value and typically range from $200 to $600 for a standard deck project. Rooftop decks and larger projects with engineering requirements may have higher fees. The fee is paid to the township at the time of application.
